State/DDTC Updates Requirements for License Support Documentation

Section 123.1(c)(4) of the International Traffic in Arms Regulations (ITAR) establishes that the Directorate of Defense Trade Controls (DDTC) may require all pertinent documentary information in order to consider the issuance of a license or other approval. Consistent with our longstanding practice, in addition to requiring a purchase order, letter of intent, or other documentation, DDTC's Office of Defense Trade Controls Licensing (DTCL) may require a signed contract to be submitted with any application for the permanent export of defense articles.
Frequently Asked Questions (FAQs): DSP-73 and DSP-61 License Applications Supporting Documentation Requirements Q: Why are we updating the guidance? A: Due to some inadequacies in our case handling system, we are asking for this additional information in order to expedite the case review. We will fix this in our future upgrades to the system but in the interim, we are asking for your indulgence. A little more effort on your part up front will decrease the overall time until the approval is back to you. Q: Why is a transmittal letter required if information already stated in application? A: While the transmittal letter may re-state information already provided in the application, it will allow the applicant to provide further insight into the transaction as well as provide information not specifically required in the license application, i.e., related voluntary disclosure (VD), customs seizure.
State DDTC Issues Updated Guidelines on Firearms and Ammunition

The U.S. Department of State’s Directorate of Defense Trade Controls (State/DDTC) has posted on its website an updated, nineteen-page Guidelines for the Permanent Export, Temporary Export, and Temporary Import of Firearms and Ammunition.

According to State/DDTC, the intent was to make the guidance more useful to help get the firearms and ammunition cases in and out of the review process quickly and help the applicants avoid RWAs. Previous guidance was dated; it intermingled the guidance for both electronic and paper submissions; and it was confusing. Also the review/rewrite provided State/DDTC the opportunity to add some additional tips to help speed the review. As for what is new, State/DDTC has streamlined the guidance. It eliminated many of the redundant paragraphs, added some guidance related to Congressional Notifications, added the hyperlinks to the forms and added a handy, dandy checklist for industry.

Click here for a copy of the new guidelines.

White House Statement on U.S. Export Control Reform Directives - January 23, 2008

The President signed today a package of directives that will ensure the United States' export control policies and practices support the National Security Strategy of 2006, while facilitating the United States' continued international economic and technological leadership.

These new directives will advance a more efficient and transparent export licensing process and enhance dispute resolution mechanisms. They will also help ensure proper levels of control for continued U.S. economic competitiveness and innovation while protecting national security. The Directives are intended to clarify and strengthen the ability of the U.S. Government to monitor and deny U.S. controlled goods, services or technologies to a potential enemy.

The United States continues to face unprecedented security challenges, including terrorist threats from the proliferation of weapons of mass destruction and advanced conventional weapons to unstable regions of the world. The United States also faces economic challenges from the increasing worldwide diffusion of high technology and global markets. As a result, the Administration will continue to ensure that our export control system is focused to meet these challenges.
