8:45 – 10:15 | Export and Foreign Agents Enforcement in a time of Unprecedented Complexity: Enforcement of trade controls and sanctions violations is rapidly increasing, and U.S. Government Agencies have issued guidance to industry regarding such enforcement measures, disclosures, and red flags. This panel will discuss such topics as:

  • Export controls and sanctions violations as a corporate criminal enforcement priority
  • DDTC’s enforcement priorities for the remainder of the year
  • Developments within the DOJ’s National Security Division with respect to the Foreign Agents Registration Act

    Post transaction investment restrictions are continuously updated and scrutinized as a result of the current geopolitical environment. This panel will provide an overview of the various investment restrictions, considerations for compliance, and the role of trade compliance professionals in effectively meeting such requirements.

    9:00– 10:15 | AUKUS Exemption – View from Australia and United Kingdom - Tracking One Year Later and Plans for Future Updates.  Leveraging AUKUS, the acronym for the trilateral security relations between Australia, the United Kingdom, and the United States, UK and Australian experts will share perspectives from their industry, impact of the excluded technology list on non-U.S. companies, timeline for approval to join the approved community, and differences in the UK and Australia's government's administration of the AUKUS exemption.  This panel will discuss the current status of AUKUS, potential changes, and how U.S. industry should engage the UK and Australia in the discussion.

      10:45  – 12:00 | DTSA's new 126.4 guidance: Since the U.S. Department of State revised the ITAR 126.4 exemption for the transfers of U.S. defense articles and defense services by/for U.S. government, there has been much discussion on how the exemption is implemented within the Services.  The panel will explain DTSA's revised guidance to the Services on how they analyze requests for "written direction," issue certification, and maintain records in USX.

      1:15– 2:15 | Implementation of CUI controls when working with Foreign Partners: Learn the process for sharing CUI with foreign partners.  Experts will share when and how to add and remove markings and best practices for sharing CUI with foreign partners.

      2:15 - 3:30 | Tariffs Panel - Hear from practitioners about the impact of tariffs with respect to obtaining duty free entry, interplay with DFARS, and flow downs in contracts from prime contractors to subcontractors.  Learn tips on how temporary import bonds or carnets can maximize your savings (or lower unanticipated costs!)

      4:00 - 5:00 | Research Security and Export Controls. NSPM-33 mandates universities receiving more than $50m in federal funds establish research security programs to protect the universities from undue foreign influence. This panel will discuss the emerging compliance field of research security and its intersection with existing trade compliance programs.
